Terms of service

The agreement between you and EKT Digital when I build or maintain a website for you. Please read it before paying a deposit.

Last updated: 4 November 2026

1. The agreement

These terms apply to all work Evan Kyle Titus, trading as EKT Digital (“I”, “me”), does for you (“you”, the client). Before work starts, I send you a written quote by email or WhatsApp that sets out the package, price and anything extra. When you pay the deposit, you accept the quote and these terms, and they form a binding agreement between us.

2. What’s included

The package in your quote, as described on the pricing section of this website at the time of the quote. Anything not in the quote, such as extra pages, online shops, copywriting beyond the standard sections, or logo design, is quoted separately before I do it.

3. What I need from you

You supply your business details, photos, logo and any text within a reasonable time. You confirm that you own, or have permission to use, everything you send me, and that the information is accurate and lawful. You are responsible for the claims made about your business on your website.

4. Timeline and changes

I aim to have your website ready for review within 5 working days of receiving everything I need. The price includes 2 rounds of changes. Further changes are charged at the rate in your quote. If you don’t respond for 30 days, I may treat the project as complete and invoice the balance.

5. Payment

A 50% deposit is due before I start. The balance is due before the website goes live on your domain. The Care Plan is billed monthly in advance. Late payment may lead to work being paused or the website being taken offline after written notice.

6. Cooling-off and cancellation

If you are a consumer, you may cancel within 7 days of paying the deposit without giving a reason and get a full refund, as section 44 of ECTA allows, unless you asked me to start work within those 7 days. After work has started, if you cancel you pay for work already done, and any unused part of the deposit is refunded. You may cancel the Care Plan at any time with one month’s notice.

7. Ownership

Once you have paid in full, the website and its content are yours to use. Your domain is registered in your name. The building blocks and code I reuse across projects stay mine, and I give you a permanent licence to use them for your website. Unless you ask me not to, I may show your website in my portfolio, and the footer includes a small “Website by EKT Digital” link, which I will remove on request.

8. Hosting and third-party services

Websites are hosted on Cloudflare and may rely on services such as Google Business Profile, WhatsApp and Paystack. I am not responsible for outages, changes or decisions by those providers, and I do not guarantee any position in Google search results.

9. Legal pages for your website

Your website includes a standard privacy policy and the business details South African law asks websites to show, based on the information you give me. These are templates, not legal advice. You remain responsible for your business complying with the law, and for asking a legal professional to review them if your business needs it.

10. Liability

I take reasonable care with every project. To the extent the law allows, my total liability to you is limited to the amount you paid me for the work in question, and I am not liable for indirect losses such as lost profits. Nothing in these terms limits your rights under the Consumer Protection Act where it applies.

11. General

South African law governs these terms. If we disagree, we will first try to resolve it by talking. I may update these terms; the version on the date of your quote applies to your project. Questions: evan@ektdigital.co.za.
